Terms of Service

1Eligibility and Account Registration

You must be at least 18 years old and capable of forming a binding contract. By creating an account or using the Service, you represent and warrant that your registration information is accurate and kept current. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account.

2Description of the Service

Viral provides tools to analyze public and authorized social-media content, websites, and related data; generate research and content recommendations; and connect third-party accounts through supported integrations. Features may change, be added, or be removed at any time.

3Third-Party API Integrations, Provider Limits, and Account Risk

The Service accesses information from third-party platforms (such as LinkedIn) exclusively through secure, authenticated API infrastructure (such as Unipile) acting on behalf of your connected account. We do not utilize headless browser bot farms or unauthorized parallel databases.

Mandatory Provider Limits: To protect the health of your connected accounts and ensure network stability, the Service strictly enforces the daily rate limits, quotas, and restrictions described in Unipile's Provider Limits and Restrictions documentation. These limits govern maximum daily actions such as profile views, search requests, and post or profile retrievals. You acknowledge that these limits are non-negotiable, are subject to change without notice based on third-party provider policies, and cannot be overridden by Viral.

LinkedIn subscription recommendation: We strongly recommend running Viral with a paid LinkedIn subscription such as LinkedIn Sales Navigator (or an equivalent premium LinkedIn tier). Sales Navigator accounts receive higher daily profile and search quotas under Unipile's guidelines, richer data, and lower enforcement risk than free LinkedIn accounts. Viral is designed for professional GTM use; connecting a free or inactive LinkedIn account may hit limits quickly and return partial data.

While our architecture is designed to respect provider limits and mimic standard usage patterns, you acknowledge that:

• Third-party platforms ultimately define and enforce their own terms of service and enforcement algorithms.
• You remain solely responsible for the configuration of your campaigns, the data you choose to retrieve, and the overall health of your connected accounts.
• We do not guarantee uninterrupted access to any third-party platform and are not liable for any account restrictions, temporary pauses, or permanent bans that result from your use of the Service.

4Your Responsibilities

You agree that you will:

• Use the Service only for lawful purposes and in compliance with these Terms.
• Obtain all rights, permissions, and consents needed to submit URLs, files, credentials, cookies, or other data to the Service.
• Not use the Service to harass, defame, spam, impersonate, infringe intellectual property, or violate privacy or data-protection laws.
• Not attempt to probe, scan, overload, reverse engineer, or circumvent security or usage limits except as expressly permitted by law.
• Evaluate all AI-generated or automated recommendations before publishing, sending, or acting on them.

5AI-Generated Output Disclaimer

The Service uses automated systems, including large language models, to produce analysis, summaries, scores, and draft content. Output may be inaccurate, incomplete, biased, or unsuitable for your audience. Viral does not provide legal, financial, compliance, medical, or professional advice. You are solely responsible for reviewing, editing, and approving anything you publish or send.

6Subscriptions, Billing, Taxes, and Refunds

Paid features are offered on a subscription basis through Stripe or other payment processors we designate. Prices, billing intervals, and included features are shown at checkout. All fees are exclusive of applicable taxes, levies, or duties (including VAT), which you are responsible for paying.

• 14-Day Initial Cancellation Right: If you are a new subscriber, you have the right to cancel your initial subscription within fourteen (14) days of your original purchase date for a full refund. To exercise this right, you must clearly notify us of your decision to cancel by emailing jasper.ruys@gmail.com before the 14-day period expires.
• 30-Day Cycle Cancellation (After 14 Days): If you cancel your subscription after the initial 14-day period has expired, your cancellation will act as a non-renewal. The cancellation will take effect at the end of your current 30-day billing cycle. You will retain access to the Service until the end of that cycle, and you are responsible for the full payment of that final month.
• No Prorated Refunds: We do not issue prorated refunds or credits for partial months or unused time. You may manage payment methods and cancel future renewals through the billing dashboard. Failure to pay may result in immediate suspension or termination of paid access.

7Intellectual Property & Marketing Rights

We and our licensors own the Service, software, branding, and underlying technology. You retain ownership of content you submit. You grant Viral a worldwide, non-exclusive license to host, process, transmit, display, and create derivative works from your submitted content solely to operate, secure, improve, and support the Service. Aggregated or de-identified data may be used for analytics and product improvement.

Publicity: You grant Viral the right to use your company name and logo as a reference for marketing or promotional purposes on our website and in other public or private communications, subject to your standard trademark usage guidelines. You may opt out of this by emailing jasper.ruys@gmail.com.

8Privacy and Data Processing

Our processing of personal data is described in our privacy practices. By using the Service, you acknowledge that we will process account, usage, billing, and content data as needed to provide the Service, including sharing data with subprocessors such as hosting providers, analytics vendors, AI model providers, payment processors, and integration partners.

GDPR Compliance: To the extent Viral processes any personal data on your behalf subject to the General Data Protection Regulation (GDPR) or similar data protection laws, the terms of our Data Processing Agreement (DPA), available upon request at jasper.ruys@gmail.com, are incorporated by reference and shall govern such processing. You acknowledge that you act as the Data Controller and Viral acts as the Data Processor.

9Confidentiality and Security

We implement reasonable technical and organizational measures to protect data, but no system is perfectly secure. You are responsible for safeguarding devices, API tokens, session cookies, and exported files generated through the Service.

10Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRAL DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any particular business, engagement, or revenue outcome will result from its use.

11Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR ACCOUNT ACCESS — INCLUDING ANY LINKEDIN OR X/TWITTER ACCOUNT BAN, RESTRICTION, OR REPUTATIONAL HARM — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO VIRAL FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

12Indemnification

You will defend, indemnify, and hold harmless Viral and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• your use of the Service to transmit abusive, harassing, or unlawful content;
• your intentional circumvention of the Service's built-in rate limits, safety guardrails, or API quotas;
• your violation of applicable privacy and electronic communication laws (including spam regulations); or
• your failure to secure all necessary rights and consents for the data you process through the Service.

13Suspension and Termination

We may suspend or terminate your access immediately if we reasonably believe you violated these Terms, pose a security risk, or if required by law or a third-party platform. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

14Changes to these Terms

We may update these Terms from time to time. When we do, we will post the revised Terms and update the version date. If changes are material, we may require you to accept the updated Terms before continuing to use the Service. Continued use after the effective date constitutes acceptance where permitted by law.

15Governing Law and Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. The courts located in Amsterdam, the Netherlands, will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction. You waive any right to participate in a class or representative action to the extent permitted by law.

16Miscellaneous

• Force Majeure: We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or major internet or infrastructure outages.
• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
• Entire Agreement: These Terms, alongside the Privacy Policy and incorporated DPA, constitute the entire agreement between you and Viral regarding the Service, superseding any prior agreements or verbal commitments.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
